General Terms and Conditions of Rental
- The bicycle, subsequently named rental object, is handed out to the lessee in a perfect technical status. The lessee makes sure, that the bicycle is free of defects, roadworthy and that he/ she got introduced into the usage of the bicycle.
- The rental charge for bicycle and accessories and the height of the deposit are documented in Su Bici´s price list.
- The rental contract can only be closed with a valid ID or passport.
- The minimum age for closure of the rental agreement is 18 years.
- The minimum age for driving an e-bike is 12 years. Person under 18 years are only allowed to use a bike if accompanied by an adult.
- The lessee must inform Su Bici immediately if any defects arise after the handover affecting the roadworthiness of the bicycle e.g., tire damages, rim damages or gear shift damages.
- The rental object can only be used for private purposes and only by the person named in the contract. Subletting or giving to third party is not allowed. It is forbidden to convert the rental object in any way. It is not allowed to use the rental object for following purposes:
- a) Carriage of person, children (except using a child seat installed by Su Bici) or animals.
- b) Ride on extreme trails and/or on beaches.
- c) Participation in bike races and/or sport competitions.
- d) Driving under the influence of alcohol and/or medication/ drugs affecting the awareness.
- e) The bikes may only be used on the slopes and trails designated by the Cabildo (https://www.senderosdelapalma.es/bicicletas/rutas-de-bicicleta-de-montana-la-palma/), not on Route 1 and hiking trails.
- f) There is no insurance in case of theft and damage, the renter bears the risks thereof.
- It is not allowed to transport the bicycle in public buses.
- The bicycle is only allowed to drive on La Palma. Transfer to neighbouring islands is forbidden.
- Duties of the lessee
- The lessee is obliged to handle the bike carefully. The local traffic rules must be followed.
- By handing over the rental object, the lessee assumes full responsibility for the rental object. Self-inflicted damage to the bike will be charged to the lessee. The lessee is liable for damage to persons and objects that arise during the rental period.
- The lessee has to secure the bike against theft. In case of theft the lessee is obliged to inform the police and Su Bici immediately. The lessee is fully liable for the loss of the rental object.
- In the event of an accident, the lessee has to prepare a written report and sketch of the accident. The report must include the names of the accident participants and possible witnesses.
- Only for e-bikes: The battery needs to be protected against outside damage and for direct sunlight. Development of heat, emergent steam or strong smell can be a sign of a serious damage and cause danger. If possible, the battery needs to be put in sand outside of closed buildings. You need to inform Su Bici instantly. If there is a fire, call the fire department, own extinguishing is not possible.
- Damages and defects on the rental object are to be reported to Su Bici immediately.
- If there is a total loss of a bicycle, the lessee owes Su Bici the replacement value of the rental object. In case of a careless or grossly negligent damage that does not lead to a total loss, the lessee has to pay for the bicycle repair.
- The lessee should have a private liability insurance. Recourse claims of the liability insurer of Su Bici as against the lessee stay untouched.
- Su Bici strongly advises you to wear a helmet. Outside of localities wearing a helmet is a duty.
- Return of rental object
- At the end of the rental period the lessee is obliged to return the rental object in person during the regular shop opening times.
- At return the rental object has to be in the same condition as it had at the handover. The bicycle needs to be roadworthy and in perfect condition. If the bicycle is very dirty, Su Bici has the right to charge 20 Euros for cleaning.
- An extension of the rental period is only possible if Su Bici is informed before the end of the rental period and confirms the extension of the term. If the bicycle is returned late Su Bici is entitled to charge the rental price for another day.
- At return the bicycle/ accessories are checked for damages. The return is documented in written form.
- Obligations of Su Bici
- Su Bici is obligated to rent out the rental object in roadworthy and fully functioning condition.
- The rental object is maintained frequently by Su Bici or a representative.
- Su Bici/ representative is only liable if acting grossly negligent or intending to cause harm.
- Subsidiary agreements are not made; changings and additions must be written down.
- Data protection
- Su Bici has the right to save the personal data of the customer and is obligated to use it only due to law regulations.
- Su Bici has the right to hand over information of the lessee to investigative authorities, when the authorities prove the start of an administrative offence or criminal case in a written form.
